Terms & Conditions

These Terms and Conditions govern bookings and participation in the ocean safaris, diving/freediving courses and expeditions organized by Baja Underwater Expeditions ("we", "the company"). By booking any of our activities, you accept the following terms.

1. Bookings and payments

Bookings are confirmed through the contact form or WhatsApp, and are subject to availability. A deposit or advance payment may be requested to secure your spot; the amount and payment method are indicated at the time of the quote. The remaining balance is settled before or at the start of the activity, unless otherwise agreed in writing.

2. Cancellation policy

Cancellations made with sufficient notice may be rescheduled or refunded according to the conditions agreed at the time of booking. Last-minute cancellations, no-shows, or interruptions caused by the client may be non-refundable. Cancellations by the company due to weather or safety conditions are fully rescheduled or refunded.

3. Assumption of risk

Diving, freediving, snorkeling and open-water activities carry inherent risks, including but not limited to currents, waves, marine wildlife, and changing weather conditions. By participating, you acknowledge these risks and confirm that you take part voluntarily and at your own responsibility, following at all times the instructions of our certified guides and instructors.

4. Health and certification requirements

It is the participant's responsibility to disclose any relevant medical condition before the activity, and to hold, where applicable, a valid diving/freediving certification required for the chosen activity. We reserve the right to decline participation to anyone whose physical condition or certification is not suitable for the activity, for safety reasons.

5. Liability

Baja Underwater Expeditions takes all reasonable safety measures, but is not liable for injuries, losses or damages arising from causes beyond our reasonable control, including weather conditions, wildlife behavior, or a participant's failure to follow safety instructions.

6. Prices and currency

Prices published on the site are shown in the currency indicated next to each activity and may vary depending on season, number of participants, or exchange rate. Packages marked "ask for a quote" are priced individually based on dates and group needs.

7. Force majeure and weather conditions

We reserve the right to modify, postpone or cancel any activity for safety reasons, adverse weather conditions, or force majeure. In such cases an alternative date or a refund will be offered, as applicable.

8. Photography and video

During activities we may take photos or videos for promotional purposes on our social media and website. If you would prefer not to appear in this material, please let us know before the activity begins.

9. Governing law

These terms are governed by the laws of Mexico, with jurisdiction in Baja California Sur. For any questions about these terms, write to us at info@bajaunderwaterexpeditions.com.
